KG Mobility ("we", "us" or "our") respects your privacy and personal information. We are compliant with the EU’s General Data Protection Regulation. This privacy notice is intended to tell you how we use any information we collect about you (called "personal information", explained below).

1. Personal Information

For the purposes of this Privacy Notice "Personal Information" consists of any information that relates to you and/or information from which you can be identified, directly or indirectly. For example, information which identifies you may consist of your name, address, telephone number, payment details, an online identifier (e.g. cookies identifiers and your IP address) or to one or more factors specific to your physical, physiological, genetic, mental, economic, cultural or social identity.

2. Personal Information Collection

The RMI website of KG Mobility ("RMI system" or "our website") collects the following information when you register with the RMI system, when you make inquiries and when you request services from the RMI system:

1) User ID
2) Password
3) E-mail address
4) Company name
5) Company address
6) Phone number
7) Country
8) VAT number
9) Distributor code
10) Member code
11) Device (DSM or VCI) serial number
12) Credit card number

3. Information Collection and its Use

The RMI system takes your privacy seriously and collects and uses your personal information as minimal as possible for the following general purposes:
1) Identify the user that willing to use the RMI system
2) Administering the Membership of the users
3) Receive user’s request in relation to use of the RMI system

The RMI system uses the collected information to verify the identification of the user registered with the RMI system as member, to prevent misuse and unauthorized use of the services, to ascertain the user’s intention to register, to limit the registration itself and to limit the frequency of the registration, to store registered information for possible dispute resolution, to entertain the complaints from the users, and to send out notices and correspondences to users.

The RMI system collects certain specific personal information for the following respective purposes:
1) ID and password are used to verify the identification of the user registered with the RMI system as member and to prevent misuse and unauthorized use of the services
2) Other selected personal/company information is used only for the purpose of providing services incorporating the user’s profession and interest, etc.

You are not required to provide any other personal information of yours other than the required information specified herein and you will not be limited to enjoy all services. The RMI system doesn't use the collected information for any marketing purposes.

4. Users located in European Economic Area (“EEA”)

For users located in EEA, all processing of personal data is performed in accordance with privacy rights and regulations following the EU Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 (the Directive), and the implementations of the Directive in local legislation. From May 25th, 2018, the Directive and local legislation based on the Directive will be replaced by the Regulations (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, known as the General Data Protection Regulation (“GDPR”), and the RMI system’s processing will take place in accordance with the GDPR.

5. Providing your personal data to others

The RMI system may disclose your personal data to us, with its principal office at 455-12, Dongsak-Ro, Pyeongtaek-Si, Gyeonggi-Do, Republic of Korea insofar as reasonably necessary for the purposes, and on the legal bases, set out in this policy. Information about our group of companies can be found at www.rmi.kg-mobility.com.
In addition to the specific disclosures of personal data set out in this Section 5, the RMI system may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. The RMI system may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

6. International transfers of your personal data

Your information that the RMI system collects when you register with the RMI system may be transferred to Republic of Korea. The hosting facilities for our website are situated in Republic of Korea. You acknowledge that personal data that you submit for publication through the RMI system may be available, via the Internet, around the world. We cannot prevent the use (or misuse) of such personal data by others.

7. Consent to Collection and Use of your Personal Information

The RMI system collects personal information as minimal as possible in a legitimate and fair manner for us to make service contracts with users and to perform the terms and conditions under such contracts made. The RMI system always requests your consent when the RMI system collects your information that is personally identifiable. In addition, when the RMI system collects personal information, the RMI system informs the users of the details about which information is collected, along with other terms and conditions, drawing the user’s attention to carefully read and consent to the privacy policy of the RMI system or agreement of use in order for the user to decide to use or cancel the services to be provided by clicking the “Agree” or “Cancel” button, respectively. Once you click the “Agree” button, you are considered to have consented to the RMI system’s collection of your personal information.

8. Consent to Use of Collected Information for other Purposes and Information Sharing to Third Party

1) The RMI system does not use collected personal information beyond the scope stipulated under the privacy policy or share the collected personal information with 3rd parties including individual and companies under any circumstances unless you consented or the relevant laws and regulations provide otherwise.
2) The RMI system only uses the collected personal information for other purposes or share it with 3rd parties upon notifying the user in advance through agreement of use, privacy policy, emails, or written correspondences of the nature of the use and sharing, i.e. with whom information is shared and its major line of business, specific information shared, and purpose of sharing.
3) The RMI system may share the personal information of the users with others to develop new technology and improve services. Even in these cases, The RMI system obtains the user’s consent in advance fully informing the details about the 3rd parties to be shared with, why and what information is used, and how and until when such information is protected and maintained. Unless the user consents, The RMI system does not collect or share additional personal information arbitrarily.
4) The RMI system does not share the personal information of the users with the advertisers even when The RMI system shows or sends advertisement to particularly targeted group based on gender and age. The RMI system only provides information in a form that is not personally identifiable even for the purpose of statistics, academic research, and market research.

The RMI system may share the personal information of the users with others under your consent for the following circumstances:
1) The RMI system may provide the necessary information of the members with outside business partners who are assigned particular services and such assignment of services to the outside business partners will be found in the privacy policy of the RMI system. The outside business partners will not use the personal information beyond the purpose of assignment or share with the 3rd parties.
2) For better services, the RMI system may create a business partnership with specialized contents business companies and various business partners to provide the users with tailored customer services, on-line advertisement services, on-line shopping mall services, user-driven web community services, paid contents services, mobile services, insurance, credit cards, telemarketing services, statistics and market research.
3) The RMI system provides and shares the necessary and required personal information of the members at its minimum with business partners only upon obtaining the consent from the members. In such case, The RMI system expressly discloses to the members about the business partners to be shared with, the purpose of such sharing and information to be shared.

However, pursuant to relevant laws and regulations, it is possible for the RMI system to provide the personal information without the consent of the members under any of the following circumstances:
1) When the users consented to the disclosure of information in advance
2) When it is necessary to make a payment for service provided
3) When a user breaches certain terms and conditions under agreement of use or company policy
4) When there is sufficient ground for disclosure of the information in connection with taking legal actions against the users who were believed to have caused mental or monetary damage to others
5) When there is ground for disclosure of the information under the relevant laws and regulations (i.e. when the RMI system is requested by government agency or enforcement authority to provide such information in due courses under certain laws)
6) When the personal information is provided to the advertisers, business partners or research organizations for the purpose of statistics, academic research, and market research in a form that is not personally identifiable

9. Processing the Collected Personal Information through the Outside Information Processing Company

The RMI system may process the collected personal information through an outside information processing company to improve services. In such case, The RMI system will notify the users and obtain user’s consent in advance. Furthermore, the RMI system makes sure that the outside information processing company is strictly bound by the terms and conditions including the protection of personal information provided, confidentiality and non-disclosure of the personal information to the 3rd parties, and information processing company’s liabilities under a written agreement with the information processing company which will be kept in a hard copy or in an electronic form.

10. Terms for Keeping and Use of the Collected Personal Information

When a member does not want to continue her membership with the RMI system, the member may request by contacting the service center of the RMI system, whereupon the RMI system will immediately out-process your membership with routine company out processing procedures. In addition, the RMI system will delete all customer information immediately after a member voluntarily dismisses herself from the membership with the RMI system. The previous member is always welcomed to re-register as member, but may not be allowed to re-register with the identical ID which previously used.

It is the policy of the RMI system to destroy the collected personal information of the members upon accomplishing the purpose of information collection in the following manner:
1) Information obtained for registration of the membership: destroyed when a member desires to be out of the membership or involuntarily dismissed.
2) Information obtained for payment: destroyed upon full payment or when statute of limitation runs out.
3) Information obtained for delivery: destroyed upon acceptance of delivery
4) Information obtained for polls and events: destroyed upon completion of such polls and events.

However, the collected personal information is kept for a certain term under the following respective circumstances:
1) Information regarding contract and cancellation of offer: 5 Years
2) Information regarding payment and supply of products: 5 Years
3) Information regarding customer’s complaints or dispute resolution: 5 Years

In addition, even after the purpose for the collected personal information has been served, the RMI system may keep the personal information if there is ground to keep such information pursuant to Korean Commercial Act or related laws and regulations under the following circumstances:
1) When there is ground to keep such information pursuant to Korean Commercial Act or related laws and regulations
2) When the members were informed or agreed in advance in due courses
3) When a member individually consented

In principle, the RMI system destroys the related personal information immediately after the purpose of the collected information has been served. Your personal information obtained in the course of registration for membership will be kept for a certain period of time in accordance with the internal company policy of the RMI system and other related laws and regulations upon accomplishment of the purpose and then destroyed.

The personal information mentioned above will not be used for other purposes except for its keeping permitted pursuant to the related laws and regulations. The collected personal information is destroyed in the following manner:
1) Information printed out on a paper: shredded or burned
2) Information stored in an electronic form: destroyed in a manner that recovery of the deleted data is not warranted.

11. Right of the Users to Review and Modify their Personal Information

The users may review and modify their personal information registered through the RMI system at any time and request for cancellation of their membership at any time. For review and modification of information, you log-in by typing your ID and password to go into the MY ACCOUNT menu and you can change all other personal information as follows except for ID and VAT No.
1) Without request : E-mail address, password, language type , phone number, device (DSM) serial number and invoicing information
2) Upon request : Company name, company address, country, distributor code, member code and PC UID

When you forget your password, you click on “Forgot Password” button and type in some required information. The RMI system will send out a temporary password to your email account after verifying your identity. Although the users may cancel their membership or certain services, such cancellation does not terminate the rights to use all services, reserving the right to use services that do not require your ID.

The RMI system may limit your ability to review and modify the personal information under the following circumstances:
1) When there is a concern that the life, property or interest of the users or certain 3rd parties may be conspicuously damaged
2) When there is a concern that ability of service providers to deliver services may be seriously compromised
3) When there is a violation of laws and regulations

12. Retention and Deletion

The RMI system will not retain data longer than is necessary to fulfill the purposes for which it was collected or as required by applicable laws or regulations. For data, the users of the RMI system have control of the purpose for collecting data, and the duration for which the personal data may be kept. Users with an active account will therefore have the responsibility to delete data when required. When a user’s account is terminated or expired, all personal data collected through the RMI system will be deleted, as required by applicable law.

13. User’s rights

In this Article 13, we have summarized the rights that you have under data protection law. Some of the rights are complex, and not all of the details have been included in our summaries. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights.

Your principal rights under data protection law are:
1) The right to access
2) The right to rectification
3) The right to erasure
4) The right to restrict processing
5) The right to object to processing
6) The right to data portability
7) The right to complain to a supervisory authority
8) The right to withdraw consent

You have the right to confirmation as to whether or not we process your personal data and, where we do, access to the personal data, together with certain additional information. That additional information includes details of the purposes of the processing, the categories of personal data concerned and the recipients of the personal data. Providing the rights and freedoms of others are not affected, we will supply to you the information of your personal data. You can access your personal data by visiting the RMI system when logged into the RMI system.

You have the right to have any inaccurate personal data about you rectified and, taking into account the purposes of the processing, to have any incomplete personal data about you completed.

In some circumstances you have the right to the erasure of your personal data without undue delay. Those circumstances include: the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; you withdraw consent to consent-based processing; you object to the processing under certain rules of applicable data protection law; the processing is for direct marketing purposes; and the personal data have been unlawfully processed. However, there are exclusions of the right to erasure. The general exclusions include where processing is necessary: for exercising the right of freedom of expression and information; for compliance with a legal obligation; or for the establishment, exercise or defence of legal claims.

In some circumstances you have the right to restrict the processing of your personal data. Those circumstances are: you contest the accuracy of the personal data; processing is unlawful but you oppose erasure; we no longer need the personal data for the purposes of our processing, but you require personal data for the establishment, exercise or defence of legal claims; and you have objected to processing, pending the verification of that objection. Where processing has been restricted on this basis, we may continue to store your personal data. However, we will only otherwise process it: with your consent; for the establishment, exercise or defence of legal claims; for the protection of the rights of another natural or legal person; or for reasons of important public Interest.

You have the right to object to our processing of your personal data on grounds relating to your particular situation, but only to the extent that the legal basis for the processing is that the processing is necessary for: the performance of a task carried out in the public interest or in the exercise of any official authority vested in us; or the purposes of the legitimate interests pursued by us or by a third party. If you make such an objection, we will cease to process the personal information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the establishment, exercise or defence of legal claims.

You have the right to object to our processing of your personal data for direct marketing purposes (including profiling for direct marketing purposes). If you make such an objection, we will cease to process your personal data for this purpose.

You have the right to object to our processing of your personal data for scientific or historical research purposes or statistical purposes on grounds relating to your particular situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

To the extent that the legal basis for our processing of your personal data is:
1) consent; or
2) that the processing is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract, and such processing may carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.

You may exercise any of your rights in relation to your personal data by written notice to us or by e-mail, in addition to the other methods specified in this Article 13.

14. Setting, Accepting and Rejecting the Cookies

For customer-tailored services, the RMI system uses and accesses the cookies which store your information. A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a web site's computers and stored on your computer's hard drive. The users are required to configure their browser to accept the cookies in order to enjoy the member services once they log on to the RMI system. The RMI system uses the cookies and searches the information on certain ID to provide more tailored and useful services to the users. The cookies recognize the computer of the user, but do not recognize the users individually. Here is how you reject the cookies

1) Open Microsoft Edge on your computer.
2) Click on button and select <Delete Browsing History>.
3) Check <Cookies and website data> and click on <Delete> button.

2. Chrome
1) Open Chrome on your computer.
2) Click More settings at the top right.
3) Click Cookies and other site data under 'Privacy and security'.
4) Select one of the following options:

- Block third-party cookies in secret mode

15. Protection of Privacy for Child under Age 14

Under the current relevant laws in Korea, a child under age 14 is required to carefully review the privacy policy and get the consent from her legal guardian before she transmits her personal information to others on line. The RMI system fully explains the above-mentioned requirement through the agreement of use or company regulations for service use and verifies whether a child under age 14 has obtained the consent from her legal guardian at the very stage of registration. The RMI system sends out an email to the legal guardians and asks them to email back with their consent. The personal information of the legal guardians will be used only for the purpose of verifying their intention to consent.

The legal guardians of the child under age 14 may request for reviewing and editing the information provided and withdrawing from their consent. Immediately upon request, the RMI system takes actions to honor such request. The RMI system does not share the personal information of child with any 3rd parties and prohibits its release until legal guardian’s request for correction of the specific personal information provided is fully entertained. All personal information of a child under age 14 will be destroyed immediately after 7 days of sign-in unless the RMI system obtains the consent from the legal guardian.

16. The RMI system’s Effort to Protect the Personal Information and Privacy

The RMI system is making all the effort in handling the collected personal information to prevent it from being lost, inadvertently released, stolen, forged or damaged. The RMI system assures the users that their personal information is thoroughly being protected by secured Password. The users are the only parties who know their ID and password and only the users are able to review and change the information with their Password. In this context, the users are advised not to let someone know their Password. It is also recommended that the users log out on line and close the browser when finished the Internet use. Especially when the users share the computer with others and use the Internet on a public venue such as company, school, library and Internet game business premises, the users should be more mindful of the recommendations stated above to protect the personal information. The RMI system also strives to protect the personal information of the members from being released or damaged by hacking and computer viruses. The RMI system regularly back-ups the data for possible loss, utilizes most advanced vaccine programs and adopts the algorithm using the password for secured transmission of the personal information on network. Furthermore, the RMI system uses firewalls to prevent unauthorized penetration into the system and tries to apply most advanced technology to create most reliable platforms for the users. The RMI system designates the persons exclusively in charge of the personal information and privacy of the users, imposes special Password which is regularly renewed and emphasizes the importance of observing the privacy policy by frequently educating the persons in charge. The RMI system further creates a very effective and responsive system under which when there are some questions raised concerning the privacy policy of the RMI system and level of observance by the persons in charge, immediate actions are taken to rectify the problems through company’s internal task forces for privacy related matters. In addition, the RMI system establishes a screening system to minimize the scope of the personal information to be printed out by limiting the purpose of the print-out. The RMI system also requires a prior permission from the persons in charge of the personal information and privacy when employees proceed to make a data file of the personal information in an Excel or similar format.

17. Questions on Breach of Privacy Policy and Reporting

The RMI system is owned and operated by KG Mobility registered in Republic of Korea with its principal office at 455-12, Dongsak-ro, Pyeongtaek-si, Gyeonggi-do, Republic of Korea. The RMI system is accepting questions and opinions concerning the protection of personal information and privacy of the users and establishing prompt feedback procedures for complaints from the users. The users are encouraged to report their complaints according to the followings, and the Officer of Privacy will reply with sufficient answers to your complaint.

18. Officer in Chief and Officer in Charge for Privacy

The RMI system is making all effort to make the users enjoy the good source of information in most secured manner. When there occur irregularities in connection with privacy contrary to all notices and policies made to the users, the officer in chief for privacy of the RMI system will be liable for such irregularities. Responsibility related to security for the use of ID and password is upon the users. Since the RMI system never directly asks about the user’s password in any manner, the users should be especially mindful of any possible release of their Password to others. As stated earlier in the preceding Article 16 of “The RMI system’s Effort to Protect the Personal Information and Privacy” the users should be much sensitive to security when they use the Internet on a public venue. If there have been any addition, deletion or modification to the privacy policy of the RMI system, the RMI system will inform you via the “Announcement” of the RMI system before the changes become effective.

We may, in its discretion, change this Privacy Policy from time to time. The updated version will be available on this page.
